2011 ChicagoBears.com Draft Challenge
Official Rules. NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING1. HOW TO ENTER. The 2011 ChicagoBears.com Draft Challenge (the "Contest") begins at 3:00:00 PM Central Time ("CT") on Monday, April 4th, 2011 and ends at 6:29:59 PM CT on Thursday, April 28th, 2011 (“Entry Period”). To enter visit www.chicagobears.com and locate the link for the 2011 ChicagoBears.com Draft Challenge. Click “Enter Now.” Entrants will be asked eight (8) multiple choice questions and a tiebreaker question based on possible scenarios regarding the 2011 NFL Draft. Each question is assigned a point value and an entrant will be awarded the points for each question he or she answers correctly. Each entrant must also complete the Entry Form which appears after the 2011 NFL Draft questions. In completing the Entry Form each entrant must provide his or her first name, last name, email address, and birth date.
2. ELIGIBILITY. The Contest is open to legal residents of the United States (excluding residents of the state of California) ages 21 years and over as of April 30, 2011. Employees, officers, directors, agents, and representatives of the Chicago Bears Football Club, Inc. (the “Chicago Bears”), MillerCoors LLC, their affiliated companies, advertising agencies, promotional partners (collectively referred to as “Sponsor Parties”) and their immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, half-sister) and/or those living in the same household of each are not eligible. Employees of any alcohol beverage retailers and distributors are also not eligible. LIMIT one (1) entry per person. Subsequent entries from the same person or email address throughout the Contest will be disqualified. Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the Chicago Bears. All federal, state and local laws and regulations apply. Void in California and where prohibited by law.
3. WINNERS. Prize winners will be determined based on the total points received for their correct answers to the 2011 NFL Draft Challenge questions. ODDS: Odds of winning depend on each entrants’ answers to the 2011 NFL Draft Challenge questions and the number of entries received. The entrant who receives the top overall score in the 2011 NFL Draft Challenge will be selected as the Grand Prize Winner. The entrants who receive the 2nd, 3rd, 4th, and 5th highest overall scores will be selected as First Place Prize Winners. The entrants who receive the 6th, 7th, 8th, 9th, 10th, 11th, 12th, 13th, 14th, and 15th highest overall scores will be selected as the Second Place Prize Winners. In case of a tie, a winner will be determined based on the entrants' answer to the tiebreaker question. If two or more entrants are still tied for a prize after the tiebreaker question is used, a winner will be determined by electronic randomized drawing.
4. PRIZES. One (1) Grand Prize Winner will receive four (4) complimentary United Club tickets to a 2011 Chicago Bears home game (Chicago Bears will select game date), one (1) parking pass for the selected Chicago Bears home game, three (3) Chicago Bears jerseys (home, away, alternate) that Grand Prize Winner will be able to customize. Approximate retail value of the Grand Prize is $1,400. Four (4) First Place Prize Winners will receive four (4) Family Day tickets and an NFL Draft mini-helmet. Approximate retail value of each First Place Prize is $50. Ten (10) Second Place Prize Winners will receive an official Bears NFL Draft Hat. Approximate retail value of each Second Place Prize is $26. Limit of one Prize per person.
5. PRIZE CONDITIONS. Judges decisions are final in all matters relating to the Contest. Chicago Bears will notify winner by email, or mail, within ten business days of the drawing date. The unavailability of a prize winner to be reached after reasonable (as determined solely by Chicago Bears) effort has been made may constitute forfeiture of being a prize winner, in Chicago Bears’ sole discretion, and an new prize winner may be selected. To qualify for a prize, a selected entrant must sign an Affidavit of Eligibility, Consent to Publicity, Liability Waiver, and federal and state tax release, all of which must be executed and returned within 14 days of the issuance of notification or such other date set by Chicago Bears. Failure to comply with all instructions in the prize notification, or return of prize notification as non-deliverable, may result in disqualification of the entry and determination of an alternate winner. Prizes will only be awarded upon final winner verification and final approval by Chicago Bears. Prizes are not transferable or redeemable for cash and prize substitutions will not be allowed, except at the sole discretion of Chicago Bears, who reserves the right to substitute a prize with another prize of greater or equal value in the event that a prize or portion of prize is unavailable. All state, federal, and local taxes or other expenses not specified herein are the sole responsibility of the winners, including, without limitation, gratuities, ground transportation, meals, souvenirs, beverages, and any expenses related to travel to and from Chicago, Illinois by the Grand Prize Winner or by the First Place Prize Winners. A 1099 tax form will be the responsibility of the winner.
6. LIMITATION OF LIABILITY. BY ENTERING THE CONTEST, ENTRANTS AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESSTHE CHICAGO BEARS, MILLERCOORS LLC, THE NATIONAL FOOTBALL LEAGUE, AND THE RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, ATTORNEYS, CONTRACTORS, ADVERTISING AGENCIES, SUCCESSORS, ASSIGNS AND INSURERS OF EACH (COLLECTIVELY, THE “RELEASED PARTIES”), FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO OR ARISE OUT OF PARTICIPATION IN THE CONTEST OR ANY PORTION THEREOF, OR THE ACCEPTANCE, USE/MISUSE OR POSSESSION OF PRIZES, OR ANY PRIZE RELATED ACTIVITY. ENTRANTS WAIVE ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
BY ACCEPTING A PRIZE, WINNERS AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM AND AGAINST ALL LIABILITY WHATSOEVER FOR INJURIES, DAMAGES OR LOSSES OF ANY KIND TO PERSON OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE CONTEST; FROM ACCEPTANCE, POSSESSION, MISUSE OR USE, AND/OR AWARDING OF ANY PRIZE; FROM PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY OR ANY TRAVEL RELATED THERETO WHICH MAY BE SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP OR USE OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, DEATH, LOSS, ACCIDENT OR DELAY TO PERSON OR PROPERTY DUE TO AN INTENTIONAL ACT AND/OR BY ANY ACT OF GOD. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED BY RELEASED PARTIES FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, RE-ROUTING, OR ACTS OF ANY GOVERNMENT OR AUTHORITY. RELEASED PARTIES MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
The National Football League, its member professional clubs, NFL Ventures, L.P., NFL Properties, NFL Enterprises LLC, NFL Productions, LLC and NFL International, LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this sweepstakes or any prize awarded. The NFL Entities have not offered or sponsored this sweepstakes in any way.
7. DISCLAIMER. The Released Parties are not responsible for printing or typographical errors in any Contest-related materials. The Released Parties reserve the right, in their sole discretion, to disqualify any individual that tampers with the entry process, and terminate, suspend, cancel or modify the Contest and award the prizes from among all eligible entries received as of the date of termination if for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, fraud, unauthorized intervention, technical failures or other causes beyond the control of the Released Parties. The Released Parties and the respective officers, directors, agents and employees of each are not responsible or liable for any events beyond the control of the Released Parties, which may cause the Contest to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Released Parties on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. The Released Parties may stop you from participating in this Contest if you ignore the Contest Official Rules or act, in the Chicago Bears’ sole discretion: (a) in a manner the Chicago Bears determine to be not fair; (b) with an intent to annoy, threaten or harass any other entrant or the Released Parties; or (c) in any other disruptive manner.
CAUTION: ANY ACT OR ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR PARTIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding the identity of the winner based on an email address, the winning entry will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry (i.e., the person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address). "Authorized account holder" is defined as the individual who is assigned to an email address by an Internet access provider, on-line service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.
8. PUBLICITY RELEASE. By participating in the Contest, the entrant irrevocably grants the Released Parties the right to use such entrant’s name, photograph, image, video, home town, and home state, in any and all media for any purpose including, without limitation, advertising and promotional purposes and each entrant hereby releases the Released Parties from any liability with respect thereto, except where prohibited. Completion of entry form constitutes assent to these written terms.
9. CHOICE OF LAW AND JURISDICTION. Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants or winners, Released Parties, and administrator in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Illinois or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of Illinois. Any action seeking legal or equitable relief arising out of or relating to the Contest or these Official Rules shall be brought only in the courts of the State of Illinois.
10. WINNERS LIST. For a list of the winners, send a self-addressed, stamped envelope to: “Chicago Bears, ATTN: 2011 Draft Challenge Contest”, Chicago Bears, 1000 Football Drive, Lake Forest, IL 60045. Requests must be received by June 1, 2011. Odds of winning depend upon the number of eligible entries received.
